Contractual conditions of carriage valid for public regular passenger transport including urban bus transport operated by Umbrella City Lines s.r.o., issued in accordance with Act No. 111/1994 Coll. on Road Transport and Decree No. 175/2000 Coll. These contractual and transport conditions are valid from 2.1.2024 in all means of transport of the carrier Umbrella City Lines s.r.o. (hereinafter referred to as the carrier) providing public passenger transport according to the valid licence and approved timetable.
Relations between the passenger and the carrier
The driver of the vehicle or any other person authorised by the carrier and equipped with a control badge or a carrier's licence (hereinafter referred to as the authorised person) is entitled to give instructions and orders to passengers to ensure their safety and the continuity of transport or the safety of other passengers.
- The authorised person is entitled to:
- a) Exclude from carriage a passenger who, at the request of the authorised person, fails to present a valid travel document and fails to fulfil the obligations to pay the fare and surcharge; exclude from carriage a passenger or order the passenger to pay the surcharge if, despite being warned, the passenger fails to comply with the transport regulations, instructions and orders of the authorised person, pollutes the vehicle or if his/her behaviour disturbs the peaceful carriage of passengers or otherwise harasses other passengers. Exclusion from the carriage must not endanger the safety and health of the passeng
- b) To refuse to carry or to exclude from carriage a passenger's luggage or an animal carried with it if they are an obstacle to the safe and comfortable carriage of passengers or endanger the health of passengers or if their carriage is not permitted by the conditions of carriage, in particular the occupancy of the vehicle.
- c) Require a passenger who has not presented a valid travel document to pay the surcharge or require the passenger to provide personal data necessary for the recovery of the surcharge.
- Obligation of the driver of a vehicle when operating a signal stop
- a) The vehicle must stop at "On Signal" stops whenever one or more persons are visibly present in the area of the stop and must also stop if another bus or trolleybus has already stopped at the stop and a passenger could be overlooked.
- b) Stopping the vehicle at "On Signal" stops whenever the passenger signals his/her wish to stop the vehicle in good time by pressing the "STOP" button once or by pressing the "Door Opening Preset", or if the passenger asks the driver to stop at the stop.
- The passenger is obliged to
- a) Observe the instructions and orders of the authorised person, which are aimed at ensuring the safety and smooth flow of traffic, his safety or the safety of other passengers.
- b) At the request of the authorised person, present a valid travel document, or, if he/she does not present a valid travel document, pay the surcharge or provide the personal data required to enforce payment of the surcharge.
- c) Pay a surcharge on demand by the person in charge for failure to comply with the timetable or the person's instructions and orders or for soiling the vehicle or for disturbing the quiet carriage of passengers or otherwise harassing passengers.
- d) Contribute to the smooth check-in process by timely preparation of appropriate payments commensurate with the fare (maximum 5 times the fare).
- e) Immediately report the damage caused by the transport to the driver, subsequent claims will not be taken into account.
- f) At the stop "On the Sign", take such a position in the area of the stop that he can be seen by the driver in time.
- g) Before stopping "On Signal", signal to the driver in good time the wish to stop the vehicle by pressing the "Signal to Driver" button, by pressing the "STOP" button for one long press, by pressing the "Door Opening Preset" button or by verbal communication to the driver.
- The surcharge is set at CZK 1,500 with:
- a) if the surcharge is paid immediately in the vehicle, the amount is reduced to CZK 1,000.
- b) If the passenger does not have a valid travel document for luggage or a dog at the time of the check, he/she is obliged to pay the corresponding fare and a surcharge of CZK 100.
- c) The surcharge of CZK 1,500 does not change in the event of a judicial recovery.
Transport conditions
These conditions apply to the carriage of persons, their luggage, goods and animals carried with them.
- Establishment of the transport contract:
- A transport contract in public line transport is created:
- a) By boarding the vehicle, unless the passenger leaves the vehicle before the journey starts
- b) By purchasing a ticket for a specific service before the transport takes place.
- c) By means of a transport contract, the carrier undertakes to the passenger who uses a vehicle operated on a public line for a specified fare to carry out his/her transport (or transports) in accordance with the transport schedule and the announcement of the transport conditions from the stop at which he/she boarded the vehicle to the stop designated in accordance with the timetable in an orderly and timely manner. The passenger undertakes by the contract of carriage to comply with the conditions of carriage and the announced conditions of carriage during the carriage, to pay the fare, except for persons carried free of charge according to the announced conditions of carriage and the tariff, and to comply with the conditions set out in the tariff.
- Method of fare payment
- The fare is paid by the passenger before the journey begins. The carrier shall ensure that the passenger who has paid the fare declared in the tariff is issued with a ticket. A passenger who fails to present a valid travel document on board the vehicle after the commencement of the carriage at the request of the authorised person shall pay the authorised person the fare declared by the tariff and a surcharge in the amount specified by the carrier in the published conditions of carriage. If the passenger's stop cannot be ascertained, the departure stop of the service shall be deemed to be the boarding stop. A passenger who wishes to continue his journey on the same service beyond the stop for which he has a valid ticket shall be obliged to obtain a ticket for the next journey without being asked to do so, at the latest before leaving that stop
- Valid travel document and method of fare payment
- A valid travel document means:
- a) a valid individual ticket issued from a ticket office on the basis of a cash or non-cash payment;
- b) a "replacement" ticket filled in by the driver issued in the event of a breakdown of the check-in equipment;
- c) a valid ID card entitling you to free transport.
- Fare payment:
- a) in the case of cash payment at the driver's, the passenger reports the type of fare, the destination stop and then pays the fare to the driver and receives a ticket;
- b) in the case of non-cash payment of fares using a payment card, the passenger follows the same procedure as for cash payment, except that the fare will be deducted from the card after it is attached to the reader at the same time as the ticket is printed
- c) in the event of a malfunction of the electronic sensor on the bus, the passenger shall pay the full fare to the bus driver in cash.
- Provision of transport services:
- Transport services are provided at a tariff which sets the amount of the fare for the carriage of a passenger, a dog and the import fee for the carriage of luggage. The fare includes designated groups of passengers and luggage which are carried free of charge. The proof of payment of the fare and import charges for the carriage of luggage, pram and dog is the ticket. The passenger shall pay the import fare when presenting the luggage for carriage.
- Obligation to show proof of fare payment:
- a) Passengers boarding the vehicle are obliged to carry a valid ticket for the given connection or another travel document specified in the tariff, or to purchase the ticket from the driver immediately and without being asked to do so when boarding the vehicle.
- b) When purchasing a ticket at a discounted fare, the passenger is obliged to present the discount card without being asked.
- c) Upon receipt of the paid document, the passenger is obliged to make sure that it has been issued as requested and that the correct amount of money has been refunded to him/her; subsequent claims will not be taken into account.
- d) The passenger must keep the ticket or other document specified in the tariff with him/her until the end of the carriage. At the request of an authorised person, he/she must present these documents at any time during the carriage and at the moment of leaving the vehicle
- e) The ticket cannot be transferred to another person once you have left the vehicle. The ticket is considered invalid.
- Assessing the validity of travel documents:
- The travel document is invalid if:
- a) the passenger has not complied with the conditions for its use laid down in the published conditions of carriage, the tariff or a special regulation;
- b) it is damaged in such a way that it does not show the information necessary to check the correctness of its use;
- c) is not filled in properly;
- d) the data do not correspond to reality or have been unlawfully altered
- e) is used by an unauthorised person;
- f) it has expired;
- g) is used without the required photo;
- h) it's not the original.
- A travel document that authorises carriage only in conjunction with another document is invalid if the passenger does not present this other document.
- The authorised person is entitled to withdraw an invalid ticket in the cases referred to in paragraph 1(d), (e), (f), (g) and (h). No other travel documents may be taken; the authorised person may use these travel documents to obtain the information necessary for the recovery of fares and surcharges
- Fare refunds:
- a) The passenger is entitled to a refund of the fare only for the reasons set out in point 10 (b) and (c).
- b) A passenger who has been excluded from carriage is not entitled to a refund of the fare.
- Passenger Obligations:
- The passenger is obliged to follow the instructions of the carrier during the carriage. The passenger may board or leave the vehicle only at the stop. The passenger must use the door as indicated for alighting. The passenger is obliged to stay on the bus and to sit down if there is a seat available on the bus. The supervision and safety of children is the responsibility of the persons accompanying them. The passenger is not allowed to:
- a) talking to the driver while driving;
- b) to board a vehicle declared occupied;
- c) staying in the driver's area and in an area that prevents the driver from seeing the vehicle safely;
- d) smoking in the vehicle, being noisy, playing music and singing;
- e) pollute or damage the vehicle;
- f) use a loud radio receiver or other reproduction equipment;
- g) consume food and drink in the vehicle.
- Exclusion of persons from transport:
- The carrier is entitled to exclude from carriage:
- a) Persons under the influence of alcohol, drugs or other intoxicants and persons who may be a nuisance to fellow passengers due to abnormal soiling of clothing or footwear or for other reasons (e.g. rioting);
- b) persons without a valid travel document;
- c) persons who endanger the safety of traffic, their own safety or the safety of other passengers and a passenger may be excluded pursuant to Decree No.175/2000 Coll., § 15 (a) to (r);
- d) persons who, despite being notified by an authorised person of the carrier, violate the provisions of the contractual conditions of carriage;
- e) people with roller skates on their feet;
- f) Children under 6 years of age unaccompanied by a passenger over 10 years of age;
- Passenger's rights in case of non-carriage:
- If the passenger has not been transported in regular passenger transport for reasons not attributable to the passenger, or if the passenger's carriage has not been completed, the passenger with a valid ticket has the right to:
- a) alternative transport to the destination, or
- b) reimbursement of the fare for the untraveled leg of the journey if the passenger is a single ticket holder, or
- c) free transport to the boarding stop, a passenger with a single journey ticket is also entitled to a refund of the fare paid in this case. In public bus transport, single fares are not refundable. If, in regular passenger transport, a passenger is not transported on time as a result of a delay in departure or arrival or loss of connection, he shall not be entitled to compensation
- d) If the passenger uses another means of transport, e.g. car, taxi, etc., because of the failure to carry out the transport, he/she is not entitled to compensation.
- e) At the passenger's request, the carrier is obliged to confirm the delay on POD lines in writing.
- Transportation of children, prams and bicycles:
- a) For safety reasons, children under 12 years of age are not permitted to be transported on a seat near the boarding door.
- b) Children under 6 years of age are not allowed to travel without a passenger over 10 years of age. Children over 6 years of age up to the age of 15 are transported at a reduced fare. Children aged 10 to 15 years must prove their age (entitlement to the discount) with a card issued by the carrier. Passes are mutually recognised between carriers. The child's age can also be proven by a valid passport or ID card.
- c) passengers with a pushchair may only get on and off the car with the driver's knowledge, and only through the designated door. The passenger shall announce his/her exit by ringing the bell twice briefly. The passenger shall arrange his/her own assistance for boarding and alighting. Two pushchairs may be carried in the vehicle, but if traffic conditions permit, the driver may exceptionally permit the carriage of additional pushchairs. The pushchair shall be transported in a designated compartment marked with a symbol.
- d) one bicycle may be carried in the vehicle with the knowledge of the driver and outside times of increased transport requirements.
- Conditions for granting discounts in suburban transport:
- a) Passengers from 6 years to 18 years - Passengers aged 6 to 15 do not qualify for discounted fares; - passengers aged 15 to 18 years shall prove their entitlement to the discounted fare by means of an officially issued valid personal identification document containing a photograph or digital image processing, name and surname and date of birth. Entitlement may also be proved by a student card containing the elements required by existing legislation and recognised by the carriers, or by an ISIC student card. When checking in a passenger, the carrier may also accept proof of age by a card issued by the carrier or by a card issued under the relevant integrated transport system.
- b) Pupils and students aged between 18 and 26 years - eligibility is proven by a valid pupil ID card containing the elements according to current legislation, i.e. a current photograph, name and surname, date of birth, name of the school. Eligibility can also be proven by a valid ISIC student card. When checking in a passenger, the carrier may also accept proof of age by a card issued by the carrier or by a card issued under the relevant integrated transport system.
- c) Travellers over 65 years of age - eligibility for discounted fares is evidenced by a European Union citizen's ID card or travel document or other officially issued valid personal identification document containing a photograph or digital image processing, name and surname and date of birth. When checking in a passenger, the carrier may also accept proof of age by a card issued by the carrier or by a card issued under the relevant integrated transport system.
- Conditions for granting discounts in public transport
- Discounts in public transport are provided according to the relevant public transport tariff conditions.
- Conditions of carriage for passengers with reduced mobility and conditions of carriage for wheelchairs.
- a) If the technical design of the vehicle and its occupancy allow it, passengers in wheelchairs may be transported in the vehicle only with the knowledge of the driver.
- b) The person in the wheelchair is responsible for their safe entry and exit and for their safety during transport.
- c) Osoba na vozíku si musí zajistit doprovod osoby, či osob (dále jen doprovod), které ji pomohou při nástupu a výstupu do a z vozidla. U bezbarierového vozidla, pokud osoba na vozíku pro invalidy sama bezpečně nastoupí a vystoupí, není doprovod nutný.
- d) When boarding a vehicle, wheelchair passengers are guided by the international symbol for accessibility or the wheelchair pictogram on the door or by the vehicle door.
- e) The wheelchair shall be equipped with an effective hand brake to prevent it from moving unaided throughout the transport.
- f) If the vehicle is equipped with a restraint system (seat belts), the person in the wheelchair is obliged to secure him/herself with the restraint system or be accompanied by an escort. If the vehicle is not equipped with a restraint system, the wheelchair user may not be transported (Act No 361/2000 Coll., § 9, paragraph 2).

- h) On vehicles equipped with a ramp, the passenger is prohibited from handling the ramp.Only an authorised person may handle the ramp.
- i) An empty wheelchair can be transported in a vehicle in designated places with the driver's consent, if the technical design of the vehicle and its occupancy permit.
- Luggage transport:
- a) a passenger shall have the right to take with him/her on board a vehicle luggage which, because of its size, length or weight, can be quickly and easily loaded and placed in the vehicle or in the luggage compartment, provided that such luggage does not endanger the safety of carriage and is not an item excluded from carriage under paragraph (d);
- b) the driver or other authorised person of the carrier decides whether the luggage will be admitted for carriage and where it will be placed in the vehicle;
- c) if the driver discovers that a passenger is carrying luggage, an object or a live animal which has not been admitted for carriage under paragraph (b), he shall be entitled to exclude the passenger from carriage;
- d) It is forbidden to transport items that endanger the safety and health of the persons being transported or are an obstacle to transport;
- e) the baggage is transported together with the passenger and under his/her supervision as hand luggage, accompanied luggage or separately as travel luggage;
- f) separate carriage shall be deemed to be the carriage of luggage stored in a place designated by the carrier outside or within the area intended for the carriage of passengers, but in such a place that the passenger is unable to supervise his luggage. The upper limit of the price of luggage which may be accepted for carriage is set at CZK 2 000.
- g) the passenger must place hand luggage or hold luggage in such a way that it does not disturb other passengers and does not obstruct access to operating equipment. If safety so requires, the passenger shall stow the luggage in accordance with the driver's instructions.
- They are excluded from transport:
- a) Dangerous articles, in particular unwrapped or unprotected items that may injure or contaminate passengers
- b) things that are smelly, corrosive, explosive, flammable and radioactive;
- c) loaded firearms, with the exception of firearms carried by authorised persons;
- d) steel cylinders of liquid fuel gas for household use with a total capacity exceeding 10 kg;
- e) Diesel containers with a total capacity of more than 20 kg;
- f) objects whose total weight exceeds 50 kg or whose dimensions are greater than 50x60x80 cm, objects in the form of a plate with dimensions greater than 100x150 cm and objects longer than 300 cm with a diameter greater than 20 cm
- Conditions for transporting animals:
- Passengers may take small pets and other animals as luggage in the vehicle, provided that they are not prevented by special regulations, are in fully enclosed containers with an impermeable bottom with dimensions of up to 30x40x60 cm and that their transport is not a nuisance to passengers (e.g. if they smell). One dog may be transported in the vehicle without a box. A passenger with a dog without a crate may board only with the knowledge of the driver. Outside of times of increased transport requirements, the driver may allow a dog of any size to be transported under the following conditions:
- a) the dog is wearing a secure muzzle and is kept on a short leash throughout the transport; the muzzle requirement does not apply to a dog that is the guide of a ZTP/P card holder;
- b) no more than one dog shall be carried in one vehicle, but this restriction shall not apply in the case of two dogs taken on board by a single passenger or service dogs or a dog accompanying a disabled person with a disabled person's pass.
